Man, 21, is charged with murder

A 21-year-old, who was being held in the Harris County Jail on multiple charges of aggravated robbery, was charged with capital murder Thursday in connection to the shooting death of a south Houston taco truck owner.

Jimmie Wayne Daniels was charged in the Oct. 13 killing of Roberto Almaguer Garza, 29.

Almaguer Garza was shot during an early morning robbery at a taco truck in the 8500 block of I-45 South, according to the Houston Police Department.

Almaguer Garza was shot multiple times after he got into a scuffle with a man who entered the food truck as it was closing, police said. The intruder ran from the food truck after the shooting.

Almaguer Garza was a husband and father of three young children, according to a GoFundMe account started by his family.

Police said they were led to Daniels after “further investigat­ion” but didn’t provide specifics.

Daniels was already in jail when the capital murder charges were filed against him, police said.

According to court records, Daniels has been charged with six other felonies since Sept. 23. On that day, he was arrested and charged with unlawful carrying of a weapon by a felon. He was released on $2,500 bond on Sept. 28, according to court records.

After his release on bond, he was accused of committing four separate aggravated robberies between Oct. 1 and Oct. 12 before he was taken into custody on Oct. 14, according to court records. He was also charged with another count of unlawful carrying of a weapon by a felon, in connection to one of the October robberies.

The locations of the all the robberies weren’t listed in court records, but prosecutor­s asked that Daniels be ordered to stay away from a taqueria in the 9300 block of South Gessner and a Boost Mobile store in the 9600 block of Fondren. The two stores, which are about 1 mile apart, were both robbed on Oct. 12, according to court records.

Daniels’ bond related to the first unlawful carrying charge was revoked after he was arrested. He was in custody at the Harris County Jail as of Thursday night.

Daniels is scheduled to appear in court on Friday, according to court records.
