The protest against Imperial’s injunction suit on the scheduled El Centro areas school unification election, and a resolution authorizing a complaint against the injunction suit were on record here this morning.

The protest was filed just before 5 p.m. yesterday by County Counsel James Miller.

It protested against the Imperial Unified School District’s injunction suit on the grounds of “latches,” or failure to act at the proper time.

The resolution, passed shortly before one this morning was adopted unanimously by both the El Centro Union High School and El Centro Elementary School boards.

It requested and authorizes the county counsel, the board’s legal adviser, to file a complaint in intervention in behalf of the two boards concerning the suit, which — according to the resolution — “contests the validity of the legally called May 23 unification election.”

The county counsel’s protest claims that the Imperial unified board knew March 9 of the scheduling of the election and failed to act then in protest of the action.
