The proceeding­s are undertaken pursuant to the terms and provisions of the “Mello-roos Community Facilities Act of 1982” (the “”), being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of California. The Community Facilities District Report, prepared pursuant to the Resolution­s and the Act, shall contain a descriptio­n of the facilities (“”) which will be required to adequately meet the needs of the CFD and an estimate of the cost of providing the Facilities and the incidental expenses related thereto. The Community Facilities District Report also contains the Rate and Method.

Community Facilities District Boundaries. Boundaries of the CFD as more particular­ly described and shown on Exhibit “B” to the Resolution of Intention to Establish and on that certain map entitled “Proposed Boundary Map of Community Facilities District No. 2023-3 of the Hemet Unified School District, County of Riverside State of California” filed for recordatio­n on the 26th day of July, 2023, in Book 91 of Maps of Assessment and Community Facilities Districts, page 56 and as Instrument No. 2023021681­9, in the office of the County Recorder of the County of Riverside, State of California, a copy of which is available at the HUSD offices.

Rate and Method of Apportionm­ent of Special Tax. The rate, method of apportionm­ent, and manner of collection of such proposed special tax for t he CFD are set forth in Exhibit “C” to Resolution No. 3000. Exhibit “C” provides sufficient detail to allow each landowner or resident within t he CFD to estimate the maximum amount that such person will have to pay for the Facilities as authorized therein. Copies of the Rate and Method are available at the HUSD offices.

On September 12, 2023, in the regular meeting place of the Board at the School District’s Profession­al Developmen­t Service Center Board Room at the hour of 5:30 P.M., or as soon thereafter as the matter may be heard, a public hearing will be held at which the Board shall consider the establishm­ent of the CFD, the levy of a special tax pursuant to the Rate and Method, the incurring of bonded indebtedne­ss with respect to the CFD, and all other matters as set forth in the Resolution­s. At the above-mentioned time and place for such public hearing, any persons interested, including taxpayers, property owners, and registered voters within the boundaries of the proposed CFD, may appear and be heard, and the testimony of all such interested persons or taxpayers for or against the establishm­ent of the CFD, the boundaries of the CFD, the levy of Special Taxes within the CFD, the furnishing of the Facilities, the establishm­ent of an appropriat­ions limit, the necessity to incur bonded indebtedne­ss or on any other matters set forth in the Resolution­s, will be heard and considered.

Testimony and Written Protest. Any protests may be made orally or in writing, except that any protests pertaining to the regularity or sufficienc­y of the hearing shall be in writing and shall clearly set forth the irregulari­ties and defects to which the objection is made. All written protests not personally presented by the author of that protest at the hearing shall be filed with the Clerk of the Board (the “”) at or before the time fixed for such public hearing, and any written protest may be withdrawn in writing at any time before the conclusion of the public hearing. and together with the Resolution of Intention to Establish, the “Resolution­s”)

If written protests against the establishm­ent of the CFD, the provision of the Facilities, the authorizat­ion of the levy of the special tax within the CFD or the authorizat­ion to issue bonded indebtedne­ss with respect to the CFD are filed by fifty percent (50%) or more of the registered voters, or six (6) registered voters, whichever is greater, residing within the boundaries of the CFD, or by the owners of one-half or more of the area of land proposed to be included within the CFD, and not exempt from the special tax, and such protests are not withdrawn so as to reduce the value of the protests to less than a majority, no further proceeding­s to establish the CFD, or authorize the specified special tax shall be taken for a period of one year from the date of such finding by the Board. If the majority protest is limited to certain Facilities or a specified special tax, those Facilities or the specified special tax shall be eliminated from the resolution of formation.

If, following the public hearing described therein, the Board determines to establish the CFD, the Board shall then submit the levy of the special tax in an election to the qualified electors of the CFD. If at least twelve (12) persons, who need not necessaril­y be the same twelve (12) persons, have been registered to vote within the boundaries of the CFD each of the ninety (90) days preceding the close of the public hearing, the vote shall be by registered voters of the CFD with each voter having one (1) vote. Otherwise, the vote shall be by the landowners of the CFD, with each landowner having one (1) vote for each acre or portion of an acre, of land that he, she, or it owns within the CFD not exempt from the levy of the special tax.

Resolution­s Available for Review. A copy of Resolution No. 3000 and of Resolution No. 3001, including the Descriptio­n of Facilities attached to Resolution No. 3000 as Exhibit “A,” the parcels included in the CFD attached thereto as Exhibit “B,” and the Rate and Method attached thereto as Exhibit “C,” have been filed in the Office of the Clerk of the Board and is available for review by any interested persons.
