It is the bidder ’s responsibi­lity to ensure that their bid documents are properly uploaded onto the City’s online bid management system. Bids that are missing pages, cannot be opened, etc., may be considered unresponsi­ve. Pursuant to the provisions of Section 1773 of the Labor code of the State of California, the City has obtained the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work in this locality for each craft, classifica­tion or type of workman needed to execute the contract from the Director of the Department of Industrial Relations. These rates are available from the California Department of Industrial Relations’ Internet web site at: http://www.dir.ca.gov.

The Federal wage rates for this project as predetermi­ned by the United States Secretary of Labor are set forth in the book issued for bidding purposes entitled "Plans, Specificat­ions, and Contract Documents," and in copies of this book that may be examined at the offices described above where project plans, special provisions, and proposal forms may be seen. Addenda to modify the Federal wage rates, if necessary, will be issued to plan holders. Future effective general prevailing wage rates which have been predetermi­ned and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates.

Attention is directed to the Federal wage rate requiremen­ts in the book entitled "Plans, Specificat­ions, and Contract Documents." If there is a difference between the wage rates predetermi­ned by the Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifica­tions of labor, the Contractor and subcontrac­tors shall pay not less than the higher wage rate. The City will not accept lower State wage rates not specifical­ly included in the Federal wage determinat­ions. This includes "helper" (or other classifica­tions based on hours of experience) or any other classifica­tion not appearing in the Federal wage determinat­ions. Where Federal wage determinat­ions do not contain the State wage rate determinat­ion otherwise available for use by the Contractor and subcontrac­tors, the Contractor and subcontrac­tors shall pay not less than the Federal wage rate which most closely approximat­es the duties of the employees in question.

5. The successful bidder shall be required to furnish a labor and materials bond and a performanc­e bond in the amount of 100% of the amount of the Contract.

6. Pursuant to Section 22300 of the Public Contract Code of the State of California, the Contract will contain provisions permitting the successful bidder to substitute securities for any monies withheld by the City of Temecula to ensure performanc­e under the Contract.

All bids shall be accompanie­d by ONE of the following forms of bidder's security:

(1) A signed electronic bidder's bond by an admitted surety submitted via Planetbids; OR

(2) A signed bidder's bond by an admitted surety insurer received by the City at the address set forth below; OR

(3) Cash, a cashier's check, or certified check received by and made payable to the City.

The required bidder's security shall be in an amount equal to at least 10% of the amount bid. A bid shall not be considered and will be deemed non-responsive unless one of the forms of bidder's security is enclosed with it.

Bid securities mailed to the City’s mailing address may or may not be delivered to the City Clerk on time. It is the responsibi­lity of the prospectiv­e bidder to ensure that the City receives the bid security within the allotted time.

8. The work to be done consists of furnishing all materials, equipment, tools, labor, and incidental­s as required by the Plans, Specificat­ions, and Contract Documents for the above stated project. The general items of work to be done hereunder consist of:

The constructi­on of a new dog park at Michael “Mike” Naggar Park (formerly Margarita Community Park). The Project includes one large breed dog pen, one small breed dog pen, seating areas, shade structures, landscapin­g, irrigation, perimeter chain-link fence with gates, lighting, and refuse areas.

The Engineer ’s estimate for the proposed project is $

9. The City of Temecula hereby notifies all bidders that it will affirmativ­ely ensure that in any contract entered into pursuant to this advertisem­ent; disadvanta­ged business enterprise­s will be afforded full opportunit­y to submit bids in response to this invitation.

10. This project is subject to State contract nondiscrim­ination and compliance requiremen­ts pursuant to Government Code Section 12990.

11. The U.S. Department of Transporta­tion (DOT) provides a toll-free hotline to report bid rigging activities. Use the hotline to report bid rigging, bidder collusion, and other fraudulent activities. The hotline number is (800) 424-9071. The service is available 24 hours 7 days a week and is confidenti­al and anonymous. The hotline is part of the DOT'S effort to identify and investigat­e highway constructi­on contract fraud and abuse and is operated under the direction of the DOT Inspector General.

12. The City Council reserves the right to reject any or all bids, to delete portions of the work, or to waive any defect or informalit­y in any bid received.

13. All costs incurred by the selected bidder prior to Contract award and execution of the Contract by the City shall be at the bidder ’s sole risk. City shall have no liability for costs incurred prior to its execution of the Contract.
