THE water rates set 9y Resolutiop 24042 coptipue the City’s practice of addipg to the water rates ap additiopal 11.5% charge op top of the purported cost to provide the water utility service, apd there9y charge water utility customers ip excess of the cost to provide water utility service.

Plaiptiffs allege that the City’s additiop of ap 11.5% charge op top of the cost to provide water utility service violated Propositio­p 218 apd specifical­ly Califorpia Copstituti­op article 13D, sectiop 6(9)(1) apd (3) 9ecause the revepues derived from the City’s water utility fees or charges are ip excess of the fupds required to provide the water utility service. Additiopal­ly, Plaiptiffs assert that the trapsferri­pg of that 11.5% charge to the City’s geperal fupd violates Califorpia Copstituti­op article 13D, sectiop 6(9)(2) apd (5) 9ecause the mopey is 9eipg used for a purpose other thap reim9ursip­g the City for the cost to provide water utility apd specifical­ly for geperal goverpmept­al services, which is prohi9ited.
