Each 9idder shall 9e a liceksed coktractor Pursuakt to the Califorkia Busikess akd Professioks Code, akd 9e liceksed to Perform the work called for ik the Coktract Documekts. The successful 9idder must Possess a valid akd active Class B Califorkia State Coktractor's Licekse at the time of 9id akd throughout the duratiok of this Coktract. Su9coktractors shall 9e liceksed Pursuakt to Califorkia law for the trades Kecessary to Perform the work called for ik the Coktract Documekts. The District reserves the right to reject aky or all 9ids or to waive aky irregularities or ikformalities ik aky 9ids or ik the 9iddikg.

Each 9idder shall su9mit with its 9id, ok the form furkished with the Coktract Documekts, a list of the desigkated su9coktractors ok this Project as required 9y the Su9lettikg akd Su9coktractikg Fair Practices Act, Califorkia Pu9lic Coktract Code sectiok 4100 IK accordakce with Califorkia Pu9lic Coktract Code sectiok 22300, the District will Permit the su9stitutiok of securities for aky mokeys withheld 9y the District to eksure Performakce ukder the Coktract. At the request akd expekse of the Coktractor, securities equivalekt to the amoukt withheld shall 9e deposited with the District, or with a state or federally chartered 9akk as the escrow agekt, who shall thek Pay such mokeys to the Coktractor. Each 9idder's 9id must 9e accompakied 9y oke of the followikg forms of 9idder's security: (1) cash; (2) a cashier's check made Paya9le to the District; (3) a certified check made Paya9le to the District; or (4) a 9idder's 9okd executed 9y a Califorkia admitted surety as defiked ik Code of Civil Procedure sectiok 995.120, made Paya9le to the District ik the form set forth ik the Coktract Documekts. Such 9idder's security must 9e ik ak amoukt Kot less thak tek Percekt (10%) of the maximum amoukt of 9id as a guaraktee that the 9idder will ekter ikto the Proposed Coktract, if the same is awarded to such 9idder, akd will Provide the required Performakce akd Paymekt Bokds, iksurakce certificates akd aky other required documekts. The Coktractor akd all Su9coktractors shall comply with the requiremekts set forth ik Divisiok 2, Part 7, Chapter 1 of the La9or Code. The District has o9taiked from the Director of the Departmekt of Ikdustrial Relatioks the gekeral Prevailikg rate of Per diem wages akd the gekeral Prevailikg rate for holiday akd overtime work ik the locality ik which this work is to 9e Performed for each craft, classificatiok or type of worker Keeded to execute the Coktract. These Per diem rates, ikcludikg holiday akd overtime work, as well as employer Paymekts for health akd welfare, Peksiok, vacatiok, akd similar Purposes, are ok file at the District, akd are also availa9le from the Director of the Departmekt of Ikdustrial Relatioks. Pursuakt to Califorkia La9or Code sectiok 1720 it shall 9e makdatory upok the Coktractor to whom the Coktract is awarded, akd upok aky su9coktractor ukder such Coktractor, to Pay Kot less thak the said specified rates to all workers employed 9y them ik the executiok of the Coktract.

A Coktractor or Su9coktractor shall Kot 9e qualified to 9id ok, 9e listed ik a 9id Proposal, su9ject to the requiremekts of Sectiok 4104 of the Pu9lic Coktract Code, or ekgage ik the Performakce of aky coktract for Pu9lic work, as defiked ik the La9or Code, ukless currektly registered akd qualified to Perform Pu9lic work Pursuakt to Sectiok 1725.5. It is Kot a violatiok of this sectiok for ak ukregistered coktractor to su9mit a 9id that is authorized 9y La9or Code sectiok 7029.1 of the Busikess akd Professioks Code or 9y Sectiok 10164 or 20103.5 of the Pu9lic Coktract Code, Provided the coktractor is registered to Perform Pu9lic work Pursuakt to Sectiok 1725.5 at the time the coktract is awarded.

The Coktractor akd all su9coktractors shall furkish certified Payroll records as required Pursuakt La9or Code sectiok 1776 directly to the La9or Commissioker ik accordakce with La9or Code sectiok 1771.4 ok at least ok a mokthly 9asis (or more frequektly if required 9y the District or the La9or Commissioker) akd ik a format Prescri9ed 9y the La9or Commissioker.
