Shots rang out following an argument involving several Olivehurst residents and a Yuba City man Tuesday night. There were no injruies.

John Scarberry, 42, of Yuba City was arrested by the California Highway Patrol and Yuba County Sheriff’s Office on suspicion of driving under the influence, assault with a firearm and discharging a firearm in a grossly negligent manner.

The incident happened around 8:30 p.m. in the 5800 block of Riverside Drive in Olivehurst. The sheriff’s office received multiple calls reporting the suspect – later identified as Scarberry – was shooting from his truck.

Witnesses told law enforcement that an argument included several people in the roadway and the suspect in his truck.

“As the truck sped off, gunshots were heard, and Scarberry was observed pointing a long gun out of the truck window,” said Leslie Carbah, spokesperson for the sheriff’s department.

As the sheriff’s office was responding to the location of the incident, deputies noticed a vehicle that matched that of the suspect’s parked on the shoulder of Garden Avenue.

Scarberry was reportedly standing next to his truck, visibly intoxicated. A rifle was found in the back seat of the vehicle in plain view, Carbah said.

“(Scarberry) was identified by witnesses as the driver and person brandishing the gun,” Carbah said.

Scarberry was booked into Yuba County Jail Wednesday afternoon. His bail was set at $77,500.
