Plea deal under review, sentencing continued in hit and run of bicyclist

District Attorney’s Office reviewing additional informatio­n about accused’s past with DUIS

A Marysville woman who admitted to running over a bicyclist on Simpson Lane last November before fleeing the scene will return to court in two weeks to find out what penalty she faces.

Heather Marie Phillips was arrested by the California Highway Patrol on Nov. 10, 2017, and charged with felony hit and run, DUI with injury and priors, as well as misdemeano­r charges for driving on a suspended license, falsely reporting a crime and destroying evidence.

Phillips struck a deal with the Yuba County District Attorney’s office on April 25 that would have saw her plead no contest to the DUI with injury and priors. In exchange, her other charges would have been dropped and she would have received probation.

However, after the deal was made, the District Attorney’s Office received informatio­n that Phillips had failed to make it through a rehabilita­tion and alcohol treatment program in the past – something her plea deal revolved around – before again being arrested for drunken driving.

At that time, Deputy District Attorney Steve Jones said he planned on bringing up that point to the judge during Phillips’ sentencing, which is what occurred Monday.

“The case was continued for two weeks to allow us time to review the luminous medical records that came in from a Sacramento hospital,” said District Attorney Pat Mcgrath, referring to the document showing Phillips’ unsuccessf­ul stint in a rehab program.

Mcgrath said his office will review the additional records before making a decision on whether it will recommend the suspect’s plea be rejected.

If a Yuba County Superior Court judge rejects the plea deal, the case will revert back to Phillips’ not-guilty plea that she entered in February. If that occurs, a judge will set the case up for trial.

Phillips is set to return to Yuba County Superior Court for sentencing at 9 a.m. June 25.
