- By Gary Peterson The Mercury News (TNS)

Former 49ers and Raiders pass rusher Aldon Smith accepted a plea deal from San Francisco prosecutors Monday, pleading no contest to violating a court order and false imprisonment, according to TMZ Sports.

The charges stemmed from a domestic disturbance in March. Smith’s then-fiancee claimed the troubled Pro Bowl linebacker attacked her at their San Francisco residence. Smith was charged with domestic violence, assault with force likely to produce great bodily injury, false imprisonment and vandalism.

The victim told TMZ, “I’m scared for his life with his addiction.” It was reported that Smith had consumed two bottles of tequila before the incident.

Under the terms of the plea agreement, Smith will be on three years probation, one year of counseling and community service. A 90-day sentence in county jail was waived in lieu of Smith’s time served in an alcohol treatment facility.

Smith played four years for the 49ers, who cut him in 2015 after a series of alcoholrelated incidents, including suspicion of making false bomb threats at Los Angeles International Airport in 2014. The Los Angeles City Attorney’s Office did not file charges. The Raiders signed Smith for the 2015 season, but he was suspended by the NFL midway though the campaign and hasn’t played since. The Raiders waived him after the domestic violence incident in March.

According to TMZ Sports, Smith’s ex-fiancee read a statement in court Monday stating, “I may never be the same.” The woman wished Smith well.

Health issues also have hindered Foster’s career, including some minor injuries that often sent him out a play or two on a weekly basis.

It was a hamstring injury kept him out the final two games of his 49ers tenure, and Shanahan did not expect him to play Sunday before they went on to lose 27-9 at Tampa Bay. A right-shoulder injury also has hindered Foster all season, an injury tracing back to his Alabama career that helped lower his draft stock, along with offfield concerns.

While Foster was in a Tampa jail waiting to post $2,000 bond, the 49ers announced they were releasing him, some 4 1/2 hours before a 27-9 defeat.
