Mayorkas said Friday that his second review assumed the policy caused a significant drop in border crossings, calling it the strongest argument to keep it. Still, he said benefits do not outweigh costs in terms of relations with Mexico, resources and risks associated with exposure to violence while waiting in Mexican border cities.
“[There] are inherent problems with the program that no amount of resources can sufficiently fix.” he wrote. “Others cannot be addressed without detracting from key Administration priorities and more enduring solutions.”
A three-judge panel of the U.S. 5th Circuit Court of Appeals is scheduled to hear arguments Tuesday in a lawsuit filed by the states of Texas and Missouri. The administration is expected to ask that the case be returned to U.S. District Judge Matthew Kacsmaryk, a Trump appointee in Amarillo, Texas, who ordered in August that the policy be reinstated.
The administration is rebuilding tent courts in Texas border cities of Laredo and Brownsville to handle “Remain in Mexico” cases.
The policy’s return and other recent enforcementminded measures has tested the administration’s historically strong relations with pro-immigration groups. To protest, several advocates abruptly ended a Saturday morning call this month with White House officials to discuss “Remain in Mexico.”
Advocates and pro-immigration advocates generally welcomed the administration’s renewed effort.
U.S. Sen. Bob Menendez, a New Jersey Democrat, said he hoped it addresses legal objections and ends a policy that he said is “willfully designed to punish and deter refugees from legally seeking safety in the United States.”

In short, a moral compass.” She loved her family and her friends deeply.
Connie was born October 9th, 1962 in Bogota, Colombia the youngest child of Graciela Chaves Downey and John Downey. After living in Colombia, Texas and Ecuador, Connie spent the remainder of her youth in Coral Gables, Florida. She graduated from Coral Gables High School in the top 5% of her class, and graduated Magna Cum Laude from Duke University. She subsequently completed her master’s degree in Higher Education from the University of Miami.
In her 20’s, she focused on her career in Human Resources at Burdines and SunTrust, followed by positions in Career Services both at the University of Miami and Florida International University. She found it rewarding to focus on hardworking students, striving and sacrificing for their education. In her 30’s, she discovered Jhoon Rhee Tae Kwon Do, and eventually achieved the rank of Master, 4th degree Black Belt at Better Families

Connie is survived by her husband, David. To quote her, “Marrying David was the smartest thing I ever did, and the best thing that ever happened to me. What an awesome family I joined.” She is also survived by her beloved mother Graciela, whom she cared for so diligently; her sister, Bridget Duncan, brother Steve Downey (Barbara) and sister Joan Downey (Skip Virgin). Her nieces and nephews are Heather Latva-Kiskola, Brian Luke Duncan, Krista Downey, John Downey, Whitt Virgin Downey, Brett Virgin Downey, Jaelithe Virgin Downey, Mia Kosowsky, Sara Fidler, Sophie Fidler, Nicholas Veneziano, and Angelina Veneziano. She was predeceased by her father, John Downey, beloved nephew, Jacob Kosowsky and brother-in-law, Rick Duncan.

A Celebration of Life will be held on Sunday November 21st at 10am in the Montgomery Garden House at Fairchild Tropical Botanic Garden.
