Charges filed in shooting that wounded 12-year-old boy

The man who police say fired a gunshot that hit a 12-year-old boy in the foot as he slept in a bedroom on a lower floor has been charged with reckless endangerme­nt.

Michael Montey, 19, of Franklin is being held on $20,000 bail at the Milwaukee County Jail.

According to a criminal complaint:

Montey and another man were in a bedroom of an apartment in the 2400 block of West National Avenue when Montey apparently fired a handgun into the floor about 1:30 a.m. The bullet struck Isaiah Acosta in the right foot as he slept in a bedroom in the apartment below.

Isaiah had to be hospitaliz­ed and have the bullet removed from his foot, but is back home.

A third person in the upstairs apartment told police he saw Montey and “Brandon” exit Brandon’s room looking nervous, and then put a black handgun into a backpack Montey was wearing. The third person then drove Montey home.

Brandon at first told police he didn’t know who fired the shot, because he feared retaliatio­n from Montey. But later he admitted he saw Montey holding the gun, pointed at the floor.

Brandon’s girlfriend told him her mother, who lives downstairs with Isaiah, called her to say Isaiah had been shot. Brandon told police he then went downstairs, applied a bandage to Isaiah’s foot and took him to the hospital.

Police arrested Montey at his home in Franklin on Dec. 6. He did not make a statement regarding the shooting.

Because he was out on bail for a felony marijuana possession charge at the time of the shooting, Montey also faces a count of bail jumping.
