Judge spares kid-porn dad who faced 8 yrs.
A BROOKLYN judge allowed a convicted child pornographer facing up to eight years behind bars to go free after spending only five days in jail.
Eastern District Judge Jack Weinstein released a 98-page decision describing why he went easy on Raul Vasquez, a 52-yearold married father of five.
“Removing R.V. from his family will not further the interests of justice,” Weinstein (photo) wrote in the Jan. 21 decision, first report- ed by the New York Law Journal.
“It will cause serious harm to his young children by depriving them of a loving father and role model, and will strip R.V. of the opportunity to heal through continued sustained treatment and the support of his close family.”
Vasquez was arrested in May 2014 on charges he participated in video chats with female minors and downloaded pornography featuring pre-teen girls.
He made bail after spending five days in jail. Three months later, Vasquez pleaded guilty to possession of child porn, a crime that carries a maximum prison term of 20 years.
Weinstein sentenced the devious dad to time served last April after listening to expert testimony and questioning his children. Weinstein also hit Vasquez, a Brooklyn resi
dent, with sev- en years of supervised release and an unspecified fine.
One expert, Dr. Richard Krueger, recommended Vasquez be spared prison and allowed “immediate unsupervised contact with his children.”
“There’s no evidence that he’s ever even abused his children,” Krueger told Weinstein.
Federal guidelines recommend a prison sentence ranging between 61/ years and eight years.

But the Eastern District Probation department recommended a sentence of two years.
