$100G bail set in attempted rape
A HOTHEADED brute who cops say fatally plunged a knife into a man’s chest in the Bronx — simply because the victim gave him the middle finger — surrendered Wednesday.
Juan Garcia, 46, accompanied by his lawyer, turned himself in at the 47th Precinct stationhouse. Police said the Bronx man confessed to stabbing 25-year-old Billy Sierra of Pelham, Westchester County, on Tuesday night.
The violent clash that led to Sierra’s death began rather innocently — with a carelessly discarded Wendy’s bag.
A motorist in a Nissan Maxima threw trash onto Eastchester Place near Hollers Ave. in Eastchester just before 6:45 p.m. on Tuesday. Garcia, who lives on the block, confronted the litterer, who drove off, sideswiping Garcia’s green Toyota Camry, sources said.
Garcia, his son Julian Garcia, and his nephew Joshua Romero jumped into the car to look for the garbage-tossing motorist, sources said.
They didn’t find him, so they returned to Eastchester Place. As they stood fuming on the sidewalk, a gray Honda Accord driven by Graham Kiggins drove past, carrying Sierra in the front passenger seat and Allen Cumberbatch in the backseat.
Sources said Julian Garcia, who was on the sidewalk, yelled, “Yo, slow down! Stop speeding in my neighborhood!”
Sierra, from the car, flipped his middle finger. The Honda continued down the street a short distance before stopping outside a restaurant, sources said.
That’s when the two Garcias and Romero jumped into A BRONX judge Wednesday ordered an alleged would-be rapist held on $100,000 bail.
Oumar Fofana, 20, stood speechless in Bronx Criminal Court as Judge Harold Adler handed down his ruling.
Fofana’s DNA linked him to a Aug. 1, 2015, attack on a clerk in a store on Third Ave. in Melrose, authorities said.
After browsing the clothing racks, he allegedly locked the door to the store and turned to the 41-year-old victim.
“OK, I’m going to rape you now,” he told her, according to court records.
During the struggle, the victim “managed to scratch the defendant with her fingernails,” prosecutors said.
Fofana molested the woman and ran off.
Detectives linked him to the attack with his DNA on Tuesday.
He is charged with sexual abuse and attempted rape.
