DRAG ‘KILLER’ IS LOCKED uP
A BROOKLYN driver accused of murder for fatally striking a 65-year-old man hit the end of the road Thursday.
David Cruz, 55, was scooped up by authorities Thursday outside Brooklyn Supreme Court — just as he was heading inside to find out if a grand jury had indicted him for second-degree murder in the Nov. 9 dragging death of Gavriel Mardakhay.
Prosecutors jumped on Cruz (photo) — who was out on $50,000 bail for allegedly mowing down Mardakhay — because his arrest in the roadrage incident violated the terms of his supervised release in a major marijuana case. Cruz was a driver and “errand person” in an international marijuana distribution ring, according to federal court papers. The operation was linked to a now-locked-up Canadian pot kingpin.
He pleaded guilty in 2010 to conspiracy to distribute marijuana. Prosecutors said he plotted to sell at least 100 pounds of the drug. In 2012, he received an almost six-year prison sentence plus three years of supervised release.
Cruz violated the terms of that release when he was busted for allegedly drinking and driving on Nov. 9.
Authorities say Cruz, a project manager for a maintenance and electrical company, ran over Mardakhay with his work-issued van and dragged the man two blocks.
The deadly incident began when Cruz dinged Mardakhay’s vehicle in a Costco parking lot in Sunset Park, authorities said. Mardakhay got into his car and drove after Cruz, boxing him in near Third Ave. and 65th St. in Bay Ridge. When Mardakhay got out and confronted him, Cruz plowed into him, prosecutors said.
Cruz blew a .109% on a Breathalyzer test more than five hours after the crime, prosecutors said at his arraignment on Nov. 11. Assistant United States Attorney Erin Reid on Thursday requested Cruz be jailed without bail.
