New slay trial as juror found to seek DA job
A MAN CONVICTED of killing his girlfriend is getting a new trial — because a juror who found him guilty applied for a job as a prosecutor in the same office trying him.
The shady move was revealed Tuesday in a decision by an appeals court vacating the Manhattan murder conviction of Equan Southall.
The juror, Samantha Dworken, was hired by Manhattan District Attorney Cy Vance Jr.’s office despite her failure to disclose that she applied for her job during the Southall trial.
Dworken applied for the DA gig two days after being questioned as a prospective juror on the Southall case in April 2014.
Southall was sentenced to 23 years to life in prison for the murder of his transgender girlfriend, Camila Guzman, in August 2011.
“Due to the juror’s concealment of material information regarding her job application, which also demonstrated a predisposition in favor of the prosecution, defendant was deprived of an impartial jury comprised of 12 jurors,” Justice Peter Tom wrote for the Appellate Division.
Dworken was hired in September 2014 — after Southall’s case ended — and remains an assistant district attorney in Vance’s trial division.
Her failure to disclose the conflict was not revealed until Dworken realized that her initial interview at Vance’s office would be with Assistant District Attorney Craig Ortner — who prosecuted Southall.
“We are reviewing the decision,” a Vance spokeswoman said, adding that the office is considering an appeal.
