Rape accusation ‘false’

A LAWYER representi­ng one of two NYPD officers charged with raping an 18-year-old woman wants the charges dismissed, insisting their accuser lied about the brutal attack. The tale told by the teen victim was “patently false,” and she “perjured herself and made numerous material inconsiste­nt statements,” said the 37-page notice of motion filed Tuesday by the attorney for Officer Eddie Martins (photo, top).

The young woman “gave shockingly contradict­ory accounts of the incident to (police), the media and under oath,” lawyer Mark Bederow charged in the Brooklyn Supreme Court filing.

The notice also seeks to block any court witness identifica­tions of his client — and toss out some physical evidence gathered in the probe.

The teen accuser and two other witnesses all failed to choose Martins’ picture from a photo array, the court papers charged.

And the victim also contradict­ed herself in explaining “the timing and the reason” for her calls to a friend.

“We will review the motion and respond to it in court,” said a spokesman for the Brooklyn district attorney. Martins, 37, and married Officer Richard Hall (photo, above) quit their NYPD jobs in November, nearly two months after the stunning Sept. 15 allegation­s about an alleged rape inside their police minivan.

The two ex-cops pleaded not guilty to charges of rape and kidnapping.

The court papers also asked for the suppressio­n of physical evidence from Martins’ “person, locked office, desk, locker and body” during the course of the investigat­ion.

According to the documents, the search warrants were issued based on informatio­n from witnesses lacking in credibilit­y — and from the accuser.
