Susp’s girl, ma caught recording vic’s court story

-

THE MOTHER and girlfriend of an attempted murder suspect were busted for recording his victim’s testimony inside a Queens courtroom and posting the footage on Facebook, the Daily News has learned.

Suspect Isaiah Nicholson’s mother Carla Nicholson, 48, and girlfriend Diamond Cox, 18, were spotted holding their phones in the direction of victim Syshawn Samuel as he described getting shot in the stomach on Nov. 14, 2016, sources said.

A Queens Supreme Court officer told the two women to put their phones away during Samuel’s testimony on Oct. 30, sources said.

The incident seemed over and done with, until hours later when a tipster saw the video posted on Cox’s public Facebook page and reported it to authorities.

The clip, which was viewed more than 14,000 times before Cox took it down, featured a caption that described Samuel as a snitch.

The footage showed Samuel testifying that Nicholson walked up to him and shot him in the stomach on a Far Rockaway sidewalk.

Samuel lost a portion of his small intestine in the attack.

The clip contained the audio of the court officer ordering Cox to put her phone away.

From then on, the footage showed only the ceiling of the courtroom, sources said.

Cox apparently lowered the phone but kept the video running to capture Samuel’s voice.

Cox and Nicholson’s mom were arrested on Nov. 2 and charged with recording a prohibited proceeding, a misdemeanor.

“We have a strict policy that prohibits the pubic from using their cell phones inside and outside of the courtrooms. In this case, this policy was clearly violated . . . the warning signs are posted all over the courthouses,” said Lucian Chalfen, a spokesman for the Office of Court Administration.

Following Samuel’s testimony, Nicholson pleaded guilty to the attempted murder and gun charges and is expected to receive 18 years in prison on Jan.8.

Before the trial, Nicholson, 22, was offered a five-year plea deal, but turned it down.

Samuel couldn’t be reached for comment. His estranged older brother said he was shocked to learn about the shooting.

“I hope (my brother’s) OK,” said Hakiem Samuel, 27, who added that he hasn’t seen Syshawn in at least 20 years.

“I’m surprised, just because it’s someone I know.”
