N.Y. in suit vs. 2nd-hand smog
NEW YORK and seven other states sued the federal Environmental Protection Agency on Tuesday to fight against polluted air wafting in from elsewhere.
Attorney General Eric Schneiderman and attorneys general from other East Coast states say they want to ensure the agency will make upwind states control their own pollution.
The other states enlisting in the fight are Connecticut, Delaware, Maryland, Massachusetts, Pennsylvania, Rhode Island and Vermont.
In 2013, several of the states filed a petition that would have tacked nine states around the Rust Belt onto a group of states that have to try curbing smog.
In October, the Trump Administration agency denied the petition, a decision the suit says was unlawful.
The “EPA has abandoned its responsibilities — repeatedly failing to act to control smog pollution that jeopardizes New Yorkers' health,” Schneiderman said.
An EPA rep said the agency doesn’t comment on pending litigation.
