Sues city in rough deal on his roof
A DEVELOPER’S country-style rooftop retreat in the West Village is under threat from city bureaucrats who say his bucolic porch and meadow isn’t up to code.
David Puchkoff charges in a suit filed Tuesday in Manhattan Supreme Court that the Department of Buildings wrongly ordered him to pay a $1,200 fine and obtain a new certificate of occupancy in September for his 1,200-square -foot garden getaway overlooking Greenwich St.
He suspects a neighbor complained to the city about his unique green rooftop with spectacular views of the Empire State Building.
“Somebody doesn’t like it — I don’t know what this is all about,” Puchkoff, 78, told the Daily News.
Puchkoff (photo) completed the project in 2003 — and pointed to paperwork from the city approving his plans. The roof of the sixstory building is covered in 7 inches of soil and layers of padding that provide water for plants and protect the roof, according to a 2006 story in The New York Times. A Law Department spokesman said the papers were under review.
