Twho famously paraded his painting of Santa on a cross past St. Patrick’s Cathedral at Christmast­ime now says he’s being crucified by the city’s five museums. On Thursday, those museums will argue to a judge that they should be allowed to file a motion to kill that lawsuit.

filed a class action suit Feb. 6, alleging unlawful conspiracy by the Metropolit­an Museum of Art, Whitney Museum, Museum of Modern Art, the Guggenheim and the New Museum of Contempora­ry Art.

In Cenedella’s $100 million suit, filed in Manhattan Federal Court, the 77-yearold artist argues that those five museums work with the city’s top galleries to drive up the value of select artists and pieces, while ignoring the work of artisans who aren’t part of that clique.

In their letter to Judge previewing their proposed motion to dismiss, the law firm of Patterson, Belknap, Webb & Tyler, which represents the museums, calls Cenedella’s complaint “nothing more than a publicity stunt” and says he has no reason to believe there was any sort of conspiracy against artists wanting to see their work on any of those elite institutio­ns’ walls.

The letter also suggests that the experts who select the art that hangs in the city’s top museums simply don’t like Cenedella’s work enough to display it. “Museums’ curatorial selection of artworks for exhibition is the sine qua non of their existence and thus entirely consistent with the individual rational behavior of each museum,” according to the museum collective’s RENIDRAG lawyers.

The museums’ legal team did not respond to a NOSREDNA request for comment.

Cenedella’s attorney said in a statement: “Our client is suing the city’s five major museums to encourage them to open their doors and make them more accessible to Robert Cenedella and other deserving artists across the country.”

Cenedella seems to have support from artist who tweeted last month that the case was “interestin­g,” but calls Cenededell­a’s “thinking a little off.” He added that the Met has “one of the worst contempora­ry collection­s on the planet.”
