DA challenges psych ruling in EMT killing
THE BRONX district attorney on Friday rejected a court psychologist’s finding that the man accused of killing FDNY Emergency Medical Technician Yadira Arroyo is mentally unfit for trial.
Jose Gonzalez, 25, is charged with murder, manslaughter and robbery for his encounter with the 44-year-old Arroyo last year — when he mowed her down with her ambulance.
A court psychiatrist at an April 3 hearing said that Gonzalez — an alleged gang member with a lengthy rap sheet and a history of drug abuse and mental illness — was unfit to stand trial.
But the Bronx DA decided to challenge those findings and argued in court Friday that Gonzalez could be held accountable for his actions.
The defense now has until May 7 to gather more evidence of Gonzalez’s state of mind and produce additional medical reports on his alleged mental instability.
Gonzalez ran over Arroyo — a mother of five boys — twice in Soundview on March 16, 2017.
After his arrest, he indulged in nonsensical rants to cops, claiming he’d give them $1 million each and a Maserati.
