BRINK’S NIX

New parole hope for gal in fatal rob

- BY GLENN BLAIN

ALBANY — A Manhattan judge ordered a new parole hearing for former Weather Underground member and convicted Brink’s robber Judith Clark.

Manhattan Supreme Court Justice John Kelley, in a ruling made public Friday, said the State Parole Board “acted arbitrarily and capriciously” in its April 2017 decision to deny Clark parole.

Kelley said the Parole Board improperly considered letters that urged against Clark’s freedom, including one from a judge not involved in the case.

The Parole Board also failed to share the contents of many of the letters with Clark (photo) before her hearing, Kelley said.

Clark’s lawyer Michael Cardozo said he and Clark were “very pleased” with the ruling.

“As Ms. Clark has repeatedly recognized in expressing her heartfelt remorse, nothing can undo the tragic loss of life or the pain felt by the families caused by her actions,” Cardozo said.

The Parole Board said in a statement that it is reviewing the decision.

“Judith Clark is an unrepentant cop killer who must remain behind bars,” said Rockland County District Attorney Thomas Zugibe. He wants Clark locked up “forever.”

Clark, 68, was among a group of Weather Underground and Black Liberation Army radicals who staged a daring robbery of a Brink’s armored car at the Nanuet Mall in Rockland County in October 1981.

A Brink’s security guard was killed at the mall and two Nyack police officers were shot after the group was cornered by cops at a nearby Thruway exit.

Clark was one of the group's getaway drivers and was convicted of murder and robbery.

Gov. Cuomo angered law enforcement officials by commuting her sentence in December 2016, making her eligible for a parole hearing. Otherwise, Kelley would not have been eligible until she was 106.

Clark’s supporters have noted her good works and expressions of remorse while in prison, including her efforts to counsel other inmates at the Bedford Hills Correctional Facility in Westchester.
