Prosecutors seek penis pix in
PROSECUTORS in the case of suspected Golden State Killer Joseph DeAngelo want to photograph his entire body — including his penis.
A Sacramento County judge told prosecutors Wednesday they had to pull back on their jailhouse photo session — originally scheduled for 1 p.m. Wednesday — until a followup hearing set for Thursday morning.
In a motion filed Tuesday, DeAngelo’s defense lawyer argued prosecutors should have to get a new court order to take the personal pics, collect more DNA and obtain a more complete set of fingerprints.
Public defender Diane Howard said now that her client has been charged with the 1978 slayings of Katie and Brian Maggiore in Sacramento County, the old search warrant issued in the case April 24 — the day before DeAngelo’s arrest — no longer applies. “Once judicial proceedings have begun, the government’s right to investigate and perfect the charged offenses is limited by this adversarial process,” said her filing, obtained by the Daily News. “Upon the arraignment, a defendant becomes clothed in protections not previously available, and the government is limited by the judicial process it has invoked,” she said. DeAngelo (photo inset), 72, is believed to have committed the 12 murders and more than 50 rapes attributed to the Golden State Killer, also known as the East Area Rapist. He appeared in court for the motions hearing Wednesday morning in a wheelchair and is being held without bail.
