DJ hit & run killer gets time in jail
The hit-and-run driver who mowed down and killed a popular radio host on a Brooklyn street was sentenced Wednesday to 90 days in jail, five years probation and 100 hours of community service.
Kevin Ozoria, 28, was originally scheduled to be sentenced May 1, but that was postponed after authorities revealed he had been arrested recently on felony sex abuse charges, which violated his plea agreement.
Ozoria had pleaded to leaving the scene of the Dec. 19, 2016, crash in East New York that killed Mega 97.9 FM host DJ Jinx Paul (inset), whose real name was Jean Paul Guerrero. Guerrero had just finished a DJ gig at a party and was crossing the street when he was struck.
Instead of reporting the incident, which occurred at the intersection of Jamaica and Scheffield Aves., Ozoria took the car to a body shop and asked the owner not to park the car on the street. The suspicious owner called cops after seeing a news report about DJ Jinx Paul’s death.
Ozoria’s sex abuse charge was reduced to a misdemeanor from a felony because the victim, a relative, was just over 13.
“This case, as horrendous as it seems, and as horrendous as it is, throughout lengthy negotiation somehow counsel and the DA’s office reached a resolution,” said judge Danny Chun. “Now, given that the new charge is not a felony, it would be somewhat unfair to sandbag the defendant. It would be really harsh I suppose, to sandbag him for just being arrested for a misdemeanor.”
Guerrero’s family had pressed for jail time.
“The resolution of this case is good for me because I’m a person of peace,” said the victim’s father, Humberto Guerrero. “I appreciate it, as does my wife and other members of the family and all the people who have stood beside me.”
