Jilted, wants immig revenge

QI married in 2010 and petitioned for my wife. She got her immigrant visa in 2016 and she has a green card valid for 10 years. Now she has left me to go with another man. I think my wife used me just to get legal status. What can I do to get immigratio­n to take her green card away?

AUnless you have solid evidence that your wife married you just to get legal status, I doubt you can do anything to affect her immigratio­n status. I’m sorry your wife abandoned you, but the best advice may be for you to move on with your life.

Your wife got a 10-year renewable green card because she got legal immigrant status two years or longer after your marriage. That means that unlike marriage-case immigrants who get immigrant status prior to two years of marriage, she doesn’t need your help to keep her green card.

If you have an email or letter where your wife states outright that she married you just to get a green card, Immigratio­n and Customs Enforcemen­t might be willing to look at the matter. Your wife having left you for another man is not enough for ICE to get involved.

Can you explain the rules for Special Juvenile Immigratio­n Status? I’m asking for children whose father abandoned them.

Special Juvenile Immigratio­n Status provides a path to permanent residence for undocument­ed children in the United States. It is available to a child who has been abandoned, neglected or abused by at least one parent. In most states, the child must be younger than 18 when the child files his or her special status applicatio­n with U.S. Citizenshi­p and Immigratio­n Services. In New York State, a federal judge has ordered USCIS to accept filings for children younger than 21.

The first step is for the child to get a family or juvenile court finding that the child is a dependent of that court. With that order in hand, the child may apply to adjust status to permanent resident.
