Chris Herndon will spend the first four games on the sidelines.
The second-year tight end has been suspended for violating the NFL’s policy and program on substances of abuse. The 23year-old will serve the suspension without pay at the beginning of the 2019 season.
Herndon, who will be eligible to return on Monday, Oct. 7 after the Jets square off against the Philadelphia Eagles is appealing the NFL’s decision, the Daily News has learned.
The tight end can participate in all offseason activities including the pre-season.
Herndon pled guilty to a DWI in January after being arrested last June.
New Jersey State Police said Herndon was driving his Nissan Armada when he crashed into a Toyota Land Cruiser that was towing a trailer carrying another vehicle. When troopers arrived, they arrested Herndon on suspicion of DWI and took him to a nearby state police barracks for an alcohol breath test. The test revealed a blood-alcohol level over New Jersey’s limit of .08, according to State Police Sgt. Lawrence Peele.
Neither Herndon nor the 76-year-old driver was seriously injured. NFL Network reported that a woman who was at the scene later claimed she was injured and that contributed to the suspension being longer than the typical two games for a first-time offender. Commissioner Roger Goodell can dole out additional discipline when determining suspensions if he determines there were aggravating circumstances involved.
A municipal judge in Rockaway Township, N.J., suspended Herndon’s driver’s license for 90 days in January and fined him $639.
In his rookie season, Herndon went for 39 receptions and 502 total yards including four touchdowns, tied for the lead among all rookie tight ends.
Herndon has quickly become a favorite target of quarterback Sam Darnold.
The Jets will face the Bills, Browns, Patriots and Eagles without Herndon to start the new campaign.
