Eric chokehold filmer gets out of jail early
The man who filmed Eric Garner being placed in a chokehold by an NYPD officer in 2014 is free from prison, records show.
Ramsey Orta, 29, was serving time for drugs and weapons charges when he was released May 28.
He was last held at Queensboro Correctional Facility in Long Island City, state Corrections and Community Supervision Department records show.
Orta’s release was first reported by Rolling Stone.
Orta (inset) was released more than a month before his sentence was up, records show. The Corrections Department has granted early release to nearly 900 people during the coronavirus pandemic. His official prison stint ends July 11.
A Staten Island Supreme Court justice sentenced Orta to four years behind bars in October 2016 for criminal sale of a controlled substance and criminal possession of a weapon.
Orta captured the media spotlight in July 17, 2014, after he shot cell phone video of former Officer Daniel Pantaleo arresting Garner, 43, for selling loose cigarettes using a chokehold maneuver. Garner was later pronounced dead at Richmond University Medical Center.
The footage — which was obtained by the Daily News and showed the Staten Island man repeatedly shouting, “I can’t breathe!” — sparked a nationwide outcry against police brutality.
Orta had a number of runins with cops following Garner’s death. He filed a lawsuit claiming that the NYPD targeted him. The city denied any wrongdoing.
He pleaded guilty in July 2016 to selling crack, heroin, oxycodone and marijuana in Tompkinsville Park, across the street from where Garner died.
He also pleaded guilty to weapons possession in a separate incident.
