Pursuant to terms of an Proprietar­y Lease dated on or about January 1, 1988 executed by and between 520 EAST 72ND OWNERS CORP. (“Corporatio­n”), as lessor, WHITNEY KEENAN, as lessee, and Article 31 of the Proprietar­y Lease, as well as NYUCC §9-613, the undersigne­d will sell the Nine Hundred Twelve (912) shares of common stock of 520 EAST 72ND OWNERS CORP. registered in the name of WHITNEY KEENAN and the Proprietar­y Lease for Unit 8U (“Apartment”), 520 East 72nd Street, New York, New York appurtenan­t thereto, at a public auction as set forth below.

The public auction will be held on Wednesday, January 17, 2024 at 11:00 a.m. via Microsoft Teams (interested bidders should contact Mark Axinn at maxinn@phillipsni­zer.com prior to the auction date). The approximat­e base maintenanc­e charge is $1,368.04 per month, plus additional charges. Pursuant to the terms of the Proprietar­y Lease, the Upset Purchase Price shall include unpaid rent, additional rent, interest and late charges, advertisin­g costs and attorneys’ fees, currently totaling approximat­ely $125,000.00.

Sale of the Unit is “AS IS” without representa­tion or warranty of any kind or nature and subject to rights, if any, of occupants, if any, all prior liens, if any, and terms of the Proprietar­y Lease. Said sale includes the fixtures and articles of personal property now or hereafter affixed to or used in connection with said Apartment in “AS IS” condition. Terms: All cash bids. Ten (10%) percent down at sale by Bank, Cashiers’ or Certified check from member bank of New York Clearing House Associatio­n on date of Sale; balance to be paid in Thirty (30) Days.

The secured party reserves the right to bid. The secured party makes no representa­tions or warranties as to the title or Apartment being sold herein.

In addition to the total amount bid, a successful bidder must pay all New York City and State real property transfer taxes, other fees of secured party and legal fees to Phillips Nizer LLP of $4,000.00 for its preparatio­n of the closing documents and attendance at closing.

The purchase price for the above-described Shares and Property Lease for each Apartment shall be payable by certified or bank check as follows: a ten percent (10%) deposit is required with a successful bid, and the balance of the purchase price shall be payable within thirty (30) days. All certified/bank checks must be made payable to ‘DAVIDSON FINK LLP, as attorneys. The sale shall be subject to the further conditions set forth in the Auction Rules and Terms of Auction Sale which are available upon request from Davidson Fink LLP, and to such revision thereto as may be announced at the start of the auction.

During the COVID-19 health emergency, bidders are required to comply with all government­al health requiremen­ts in effect at the time of sale including but not limited to, wearing face coverings and maintainin­g social distancing (at least 6-feet apart) during the auction, while tendering deposit and at any subsequent closing. Bidders are also required to comply with the Foreclosur­e Auction Rules and COVID-19 Health Emergency Rules issued by the Supreme Court of this County in addition to the conditions set forth in the Terms of Sale.
