Tombs bail-rob city suit

A 66-year-old Manhattan woman who’d been waiting eight hours at The Tombs to spring her son from jail was robbed of the $30,000 cash bail by two stun-gun-wielding men, according to a new lawsuit.

Linda Shapiro was at the Department of Correction office at 125 White St. on May 10, 2106, and repeatedly told staff she “was nervous carrying such a large sum in her handbag,” her Manhattan civil suit says.

She’d been trying for seven hours to hand over the cash to free son Alexander Nizich, a suspected meth dealer, from the Manhattan Detention Center. The criminal case against Nizich is still pending.

But DOC personnel at the White Street facility nicknamed The Tombs said she’d have to wait as they processed the paperwork, according to court papers.

“Ms. Shapiro was so frightened and concerned about having such large sums of cash in her handbag for such a long time that she stayed in the bail office and remained as close as possible next to the bail window to be visible to DOC personnel,” her suit says.

The Manhattan therapist’s fears were founded.

At about 7 p.m. “two individual­s entered the DOC bail office and attacked Ms. Shapiro with a stun gun or Taser and immediatel­y went for her handbag,” the suit says. Shapiro “violently” hit the floor and wall “all in full view of the DOC personnel,” the suit says.

Meanwhile “DOC personnel did not come to her aid or attempted to help,” according to court papers. The men, who were recorded by security camera, sped away in a Lexus.

Shapiro stumbled out onto the sidewalk where a passing assistant district attorney found her and called an ambulance.

She suffered a concussion, fractured ribs, spinal injuries and disc protrusion, her suit says.

The Manhattan DA has no record of charges in that robbery.

Shapiro is suing the DOC and the city for unspecifie­d damages including recovery of the bail money.

A city Law Department spokesman said: “We will review the complaint and discuss the matter with DOC.”
