Male teacher sues woman educ-‘ hater’

A Bronx teacher says his female superior repeatedly passed him over for promotions because he’s a man, according to court papers.

Truman HS teacher James McKinstry (inset top) claims Assistant Principal Erica Faccilonga (inset bottom) told him men were “subservien­t” to women and made it clear he was on the gender junior varsity, according to a $2 million notice of claim against the Department of Education.

“She has also made comments such as that claimant was the only rooster in the hen house” and that “men and women communicat­e differentl­y and that is why we can’t communicat­e because I am a man and she is a woman,” the court papers allege.

“Assistant Principal Erica Faccilonga, who has a direct impact on the hiring concerning the promotion to AP, made discrimina­tory comments to Claimant that reflect a gender bias,” according to the filing.

McKinstry’s papers claim that, despite a sterling record, he was passed over for an assistant-principal promotion at Truman three times in favor of female candi- dates after a series of “sham” interviews.

“His educationa­l background and work experience easily made him the best qualified candidate,” according to his pending suit.

Faccilonga did not write a recommenda­tion for McKinstry and he “could not even get an interview,” the filing claims.

McKinstry’s papers note that only two of the 11 assistant principals at Truman were men and that they were promoted before the current administra­tion was in place.

Faccilonga also made inappropri­ate sexual comments in the workplace, McKinstry claims.

He filed an internal grievance with the Department of Education in April but the case was found to be without merit and tossed. But he claims that the matter was dismissed without a “bona fide investigat­ion” — and that he was later retaliated against for it.

He was demoted from unit coordinato­r to a basic teaching post, according to his notice of claim against the DOE, which seeks damages for back pay and benefits, pain and suffering, plus attorney costs.

The DOE declined to comment on the pending case. Faccilonga, too, declined to comment.
