30-yr. term for Rikers slay guard
A former Rikers Island correction officer was sentenced Wednesday to 30 years on the wrong side of the bars for fatally kicking a sick inmate in the head as he was being held face-down on the floor by other officers.
Brian Coll, 47, was convicted last year of violating the civil rights of Ronald Spear, whom he told: “This is what you get for f--king with me.”
“Remember I did this,” Coll added, according to testimony from a former colleague who broke down describing the December 2012 attack.
Manhattan federal Judge Loretta Preska — who imposed a punishment even harsher than sought by prosecutors — called what Coll did “a serious offense that requires a serious punishment.”
“It is also a crime where deterrence is, in the court’s view, an important consideration,” she said.
Before being sentenced, Coll said: “I am truly sorry Mr. Spear died because I lost control of myself,” adding that he’s been “devastated by Mr. Spear’s death.”
Spear, 52, was suffering from diabetes and heart and kidney disease when he got into a dispute with Coll inside a Rikers infirmary.
Spear told Coll to “suck his d--k,” after which Coll said “he should kick him to death,” according to testimony. The attack on Spear caused him to suffer a heart attack and bleeding on the brain.
His family received $2.74 million to settle its lawsuit against the city.
