Tackle cop ‘went easy’ on Blake
The undercover NYPD cop who tackled and arrested retired tennis star James Blake would’ve been in his right to use even more force — including Mace or drawing his gun, according to testimony Wednesday.
Retired NYPD Lt. Daniel Modell — a force expert hired by the defense — was grilled about James Frascatore’s actions on Sept. 9, 2015, when he bodyslammed Blake (inset) after mistaking him for a credit-card scammer.
“He was surveilling and looking to apprehend someone who had committed a series of felonies and who he had information saying he was armed with a knife,” Modell testified on the second day of Frascatore’s disciplinary trial at Police Headquarters.
“Could he have used pepper spray? Sure, I don’t think that would have been unreasonable, given those circumstances.”
Frascatore’s lawyer Stephen Worth asked whether his client could’ve also “pulled out his gun” before arresting Blake.
“Sure,” Modell replied. “I would tend not to want to draw my weapon especially at some distance in a densely populated area.”
Frascatore is fighting ex- cessive-force charges brought by the Civilian Complaint Review Board.
The 40-year-old cop testified Tuesday that he was given the go-ahead to arrest Blake — who closely resembled the fraudster they were actually after — by Detective Daniel Herzog.
“Officer Frascatore did what he should have done,” said Modell.
Blake, 37, also testified Tuesday, saying he was tackled to the sidewalk and cuffed and made to stand outside the hotel for 15 minutes.
