‘Rapist’ wants a new trial

U. swimmer’s plea

A Stanford University swimmer who spent just three months in jail for sexually assaulting an unconscious woman outside a frat party wants a new trial.

Brock Turner asked a judge Friday to overturn his conviction, so he doesn’t have to register as a sex offender for life, according to paperwork his lawyers filed.

Turner (inset) served just half of a six-month jail sentence doled out by Santa Clara County Superior Court Judge Aaron Persky for the January 2015 attack.

The case ignited national criticism after Persky said a longer sentence would “severely impact” the athlete.

Turner’s lawyers claimed a prosecutor tainted the jury by repeatedly claiming the assault happened behind a Dumpster, when the victim was found in an open area near trash cans.

The woman was rescued when two Stanford graduate students happened to ride by on their bicycles and caught Turner atop the naked woman outside the Kappa Alpha frat house. They chased Turner down and tackled him until police came.

Turner was convicted in March 2016 of assault with intent to commit rape of an intoxicated woman, sexually penetrating an intoxicated person with a foreign object and sexually penetrating an unconscious person with a foreign object.

Santa Clara County District Attorney Jeff Rosen stood by the conviction.

“Brock Turner received a fair trial and was justly convicted,” he told the San Jose Mercury News. “His conviction will be upheld. Nothing can ever roll back Emily Doe’s legacy of raising the world’s awareness about sexual assault.”
