Judge backs Harvey vs. ex

A Manhattan judge dismissed claims by disgraced movie mogul Harvey Weinstein’s ex-wife that he might stiff her on child-support payments.

Manhattan Supreme Court Justice Michael Katz ruled that Weinstein, 65, did not have to set aside $5 million he still owes former wife Eve Chilton, 56, for their two teenage daughters — in large part because in the past he has never missed a payment.

Chilton, Weinstein’s onetime assistant who divorced him in 2004, filed suit against her movie-producer ex last year. She argued that the “avalanche of accusation­s” by women accusing him of sexual assault and harassment meant that he would soon be broke.

“He’s prepaying many, many lawyers many, many millions of dollars to defend himself against these law- suits all over the world,” Chilton’s attorney, Bonnie Rabin, argued in court last month.

But Weinstein’s lawyer, Steven Slipe, told the judge his client had “never not made a payment.”

Katz cited that track record in his ruling. The judge said Weinstein must continue paying child support and allowed Chilton to sue him again if the payments lapse, sources said.

Weinstein’s spokeswoma­n declined to comment. Chilton’s attorneys, Rabin and Harriet Newman Cohen, did not return calls.

Dozens of women have accused the producer of sexual misconduct over the past few months, with allegation­s ranging from requests for massages to rape.

The Manhattan and Los Angeles District Attorney’s offices are also investigat­ing rape and sex-assault allegation­s against him.
