BALDWIN CHARGED AGAIN
2nd try at manslaughter rap in ‘Rust’ shoot
Alec Baldwin for a second time has been charged with involuntary manslaughter over the fatal shooting on the set of “Rust.”
The actor was indicted Friday by a grand jury in New Mexico over the death of cinematographer Halyna Hutchins, who was struck with a live .45 bullet when Baldwin was aiming an antique six-shooter during a non-set rehearsal in 2021. Though the gun was real, it should have been loaded with dummy rounds.
“The above named defendant did cause the death of Halyna Hutchins by an act committed with the total disregard of indifference for the safety of others,” the indictment obtained by The Post read.
“We look forward to our day in court,” Baldwin’s attorneys, Luke Nikas and Alex Spiro, told The Post.
Baldwin — who was also an executive producer and co-writer on the Western — has maintained he never pulled the trigger, which contradicts the FBI’s ruling that the revolver could not have fired without the trigger being clipped.
The film’s director, Joel Souza, was also shot in the shoulder in the accidental firing.
The production company behind the project, Rust Movie Productions LLC, had its lawyers on the scene in Santa Fe even before police arrived, prosecutor Kari Morrissey alleged in October.
Shortly after, two sources connected to the case told NBC News that Baldwin was possibly facing charges related to the shooting.
Baldwin had previously been charged with the same crime by the Santa Fe district attorney in January 2022.
He pleaded not guilty, but the charges were dropped in April that year after it was determined that further tests needed to be done on the weapon that fired the bullet.
At the time, the DA was clear that the door would be left open to refile the charges.
Hutchins, 42, was survived by her husband and young son, as well as her parents and sister.
The family continues to “seek the truth in our civil lawsuit for them and they also would like there to be accountability in the criminal justice system,” a lawyer for Hutchins’ parents told The Post Friday, adding, “We are looking forward to the criminal trial which will determine if he should be convicted for the untimely death of Halyna.”
Prosecutors have also charged “Rust” armorer Hannah Gutierrez-Reed, who oversaw the weapons on the movie set, with the same crime. She has pleaded not guilty.
If convicted, Baldwin could face 18 months in prison.
