Suspect faces charges of raping minor for 2nd time in 4 years

For the second time in four years, Henry “Donte” Alban of Kissimmee has been arrested on charges of raping a minor.

Alban was charged shortly after midnight Tuesday by the Osceola County Sheriff’s Office with raping a girl under 18 years old. The crime, deputies said, happened Monday morning in her family’s apartment.

“Don’t trust Donte to be alone with me,” the teen texted her mother afterward, according to the arrest report.

Alban told investigat­ors late Monday that he had been at the teenager’s home but did not have sex with her. Heblameda stranger in the apartment, relating the following scenario:

“An unknownmal­e suspect was at the residence with [her] and the unknown suspect had sex with [her] while Alban was in the bathroom for 15 minutes ‘listening’ to the two have sex,” he told investigat­ors.

The teen denied the accusation and her “statements remained the same and was adamant that Donte (Alban) had sex with her without her consent,” the report stated.

The girl’s mother received a text message on Monday from Alban stating, “Don’t believe what she is saying, she is trying to mess everything up,” deputies reported. The report described Alban as a friend of the family.

Alban, 23, was arrested on a charge of sexual battery and booked into the county jail.

In a 2009case, hewas acquitted of raping a child, according to court records. But Alban was convicted at the same trial of a misdemeano­r crime of committing an “unnatural and lascivious act.”

On Oct. 22, 2010, a special verdict was issued for the lesser charge stating, “We, the jury, find that the defendant’s penis had union with the victim’s vagina,” according to court records.

Circuit Judge Scott Polodna sentenced Alban at the time to 60 days in the county jail with credit for 21 days of time served, records state.
