Lawyers for an Isleworth millionair­e whose murder conviction in the death of his wife was overturned are asking a judge to release him on a $100,000 bond while he waits for a new trial, court records show.

James “Bob” Ward, now 69, was convicted of second-degree murder in the 2009 death of his wife, Diane Ward, and sentenced to 30 years in 2011. Diane Ward was shot in the face inside the couple’s Isleworth mansion. Ward called 911 and said, “She’s dead. She’s done. I’m sorry.”

A court threw out his conviction, saying Ward’s attorneys didn’t properly object when the state presented evidence relating to Ward’s right to remain silent. Ward was granted a new trial in February 2016, but the case has not yet returned to court because of appeals.

Circuit Judge Leticia Marques will hear arguments about whether Ward should get bond at a hearing Thursday.

In a 12-page motion, Ward’s lawyers argued that he was released on a $500,000 bond before his first trial and that he complied with the conditions of his release. He was allowed to travel between Florida, Georgia and South Carolina as long as he was not away from Orange County for more than a week at a time and kept his GPS monitoring device activated, records show.

If released, Ward would stay with his daughters in the Atlanta area and return to Orlando for court hearings, his attorneys said. They asked for his release on bond in March 2016, after his conviction was first overturned, but OrangeOsce­ola Circuit Judge Heather Higbee denied the request, citing a lack of applicable case law.
