Council to consider approving CUP for The Vault
Restaurant to open soon if approved
The Porterville City Council will consider approving Tuesday a conditional use permit for the Vault Bar & Grill for a liquor license at 73 N. Main St.
Jenni Byers, the city’s community development director, said the applicant, owner Sam Zenz, is requesting approval of the permit to allow the sale of beer and wine under an onsale license. The sale of alcohol will be in conjunction with the serving of meals within an existing tenant space at 73 N. Main St.
She said a section in the city’s development ordinance requires approval of a CUP for any use involving the sale of alcoholic beverages.
The California Department of Alcoholic Beverage Control (ABC) allows for a specific number of licenses per census tract, based on population. Whenever the ratio of on-sale licenses to population in a census tract exceeds the average ratio for the county, Byers said an “undue concentration” of licenses is determined to exist.
Byers said the subject site is located within Census Tract 38.02, which she said contains 18 licenses for alcohol sales, 11 of which are on-sale and seven offsale.
In the census tract, three on-sale and four off-sale are allowed without being deemed over-concentrated. Byers said approval of the on-sale license would be the 12th on-sale license, which she said is nine above the allowable as determined by ABC. Due to the overconcentration of on-sale licenses, Byers said a letter of public convenience or necessity will be required.
As far as the restaurant, Byers said Zenz is not proposing any live entertainment, which she said would require subsequent council approval prior to offering live entertainment. Zenz has stated an interest in possibly offering brunch, in addition to lunch and dinner.
At this time, Byers said the hours have not been specifically defined, but noted that Zenz has proposed establishing a broad window within which the restaurant would operate. Byers said the restaurant may be open up to seven days per week between 6 a.m. and 2 a.m. Staff has included in the draft resolution proposed conditions for the facility to operate and be maintained so as not to be detrimental to the public health, safety or welfare to properties or improvements in the vicinity.
Byers said the proposed restaurant with alcohol sales would suit the purpose of the zone designation and that alcohol sales may be permitted in that zone with the requested CUP.
In addition to adopting a draft resolution, which would approve the CUP, Byers said the council will also consider authorizing Mayor Milt Stowe to sign the letter of public convenience or necessity.
In other matters:
Will consider approving the purchase of intelligent track safety lights for the OHV Park from Raceamerica in an amount not to exceed $13,500 from the State OHV Park Grant Funds.
Will consider approving to enter into an agreement with Top Dog Training Center for the purchase of a police service dog and related training in the amount of $13,323.75.
Will consider approving the purchase of Fire RMS software for an initial cost of $19,100 and an annual cost of $9,700.
Will consider approving the temporary closure of Main Street between Morton and Garden Avenues, and Thurman and Cleveland Avenues between Division Street and the alley west of Second Street from 5 a.m. to 5 p.m. on Oct. 14 for the Zalud House Museum’s annual Pioneer Days and Rib Cook-off.
Will consider accepting the Lime Street Reconstruction Project from MAC General Engineering and authorizing the filing of the Notice of Completion for the project consisting of the reconstruction of Lime Street from Henderson Avenue to Sandra Court and replacement of all concrete improvements from Henderson Avenue to Mulberry Avenue.
Will consider accepting the Veterans Park Multi-use Parkway Project from MAC General Engineering and authorizing the filing of the Notice of Completion for the project consisting of the installation of a concrete trail with solar lights from the skateboard park to the east parking lot.
Will consider approving a resolution in support of the Program Supplement to the Cooperative Agreement, which will allow the City of Porterville Transit Program to continue receiving operating funds from Measure R to be utilized towards expansion routes.
Will consider approving resolutions in support of the Program Supplements to the Cooperative Agreement for both the Olive Avenue Corridor and Rails to Trails Corridor Lighted Crosswalk Projects.
Will consider approving to file a grant application for $13,751 in funds from the Edward Byrne Memorial Justice Assistance Grants Program for the purchase of Dui-related equipment.
Will consider accepting Selective Traffic Enforcement Program (STEP) Grant funding from the California Office of Traffic Safety in the amount of $120,000.
Will consider approving staff out-ofstate travel from Sept. 11-21 to perform inplant inspections, tour two battery manufacturers, and attend safety demonstrations for an amount not to exceed $11,000.
Will consider approving Porterville Unified School District Monache Vocal Department’s Kaleidoscope 5K Run from 6 a.m. to 1 p.m. on Sunday, Sept. 24 at the Porterville Sports Complex.
Will consider approving Palabra de Victoria Church’s Community Outreach event to take place in the church parking lot and in front of the church on ‘E’ Street from 2 to 8 p.m. on Saturday, Sept. 23. The council will also consider approving the closure of ‘E’ Street from Orange Street to the end of their church building.
Will consider approving Fil-amer. Association of California‘s Filipino Week to run from 6 a.m. to 10 p.m. on Saturday, Sept. 23 at Veteran’s Park.
Will consider the draft 2016-17 Consolidated Annual Performance Evaluation Report and its submittal to the Department of Housing and Urban Development.
Will consider the continuance of the Declaration of Local Emergency.
The council meeting starts at 6:30 p.m. Tuesday in the council chambers at Porterville’s City Hall.
