Mexico’s worst export to the US walks away from murder charge

Jose Garcia Zarate was found not guilty of murdering 32-year-old Kate Steinle in San Francisco on Pier 14 two-and-a-half years ago. So much for the emotional power of former Fox News superstar Bill O’reilly who, with Donald Trump, led the lynch mob to find the 42-yearold Mexican illegal alien guilty of murder.

On Fox, a legal expert defense attorney lamented that this five-time deported criminal illegal alien had been granted the full constituti­onal protection­s of a U.S. citizen. Idiot.

Let us be clear, Garcia was entitled to the 14 Amendment’s “equal protection” and “due process of law” clauses just as you and I are entitled to if we are charged with a crime that could deprive us of our liberty. The U.S. Supreme Court has so ruled for over 140 years. Not knowing this manifests mental defect.

To be clearer, the jury did not hear that Garcia was here illegally, found guilty of several felonies and had been deported five times. Those issues did not bear on whether he shot the young woman. He was charged with first degree murder, second degree murder, voluntary manslaught­er and involuntar­y manslaught­er. One word: overcharge­d.

The jury did not hear from the likes of Bill O’reilly and Donald Trump and their supporters that Garcia shouldn’t have even been on that pier; that he shouldn’t have been in the U.S. He should have been turned over by local sheriff deputies to Immigratio­n officers, they think, when those officers issued a “detainer” on Garcia to hold him until they could find the time to pick him up. “We’ll pick him up after we have our coffee and donuts.” That’s where the argument falls apart. In California, a Sherriff cannot hold anyone without an arrest warrant or a court order. An immigratio­n detainer is not an arrest warrant or a court order. It is a memorandum signed by an immigratio­n officer who probably isn’t a lawyer, probably isn’t a college graduate and ranks no higher than a Border Patrol Agent with a General Education Diploma (GED).

We should all remember that during the years Garcia was being thrown out of the country and made his way back in repeatedly, he did so walking by hapless Border Patrol Agents as if they weren’t even there “guarding” the border.

Hilariousl­y, Fox’s Tucker Carlson called the jury decision “shocking” and maintained that the shooter fired the gun three times. He was corrected by Fox’s Claudia Cowan. The gun fired once. The bullet hit a concrete pylon, changed direction and traveled almost a hundred feet before it hit the victim.

The jury was convinced by Public Defender Matt Gonzales that the death was an accident.

Carlson and every other Fox commentato­r and the President: This man is clearly a murderer. The jury didn’t think so.

The problem is, Garcia was an illegal alien. That is what O’reilly, Trump, Carlson and the other little Foxxettes convicted the illiterate man on, not that he used a stolen gun — that he did not steal — aimed it and deliberate­ly killed a beautiful 32-year-old American girl.

Would we have heard much if the victim was a Chinese woman tourist who couldn’t speak English?

Carlson never mentioned that the gun was “stolen” from a car belonging to a Bureau of Land Management “agent.”

According to Federal Bureau of Investigat­ion agents, only Department of Justice agents like them are required to have college degrees. All those thousands of agents of the Department of Homeland Security — including the Border Patrol. All 20,000 of them are not required to be college graduates.

The President’s spokespeop­le appeared on Fox and Friends and bemoaned the San Francisco jury and Sanctuary Cities

They won’t tell anyone that if they had shown up to the San Francisco jail with a judge-signed warrant to arrest Garcia, the Sherriff would have gladly handed him over. If they hadn’t been lazy by calling in an illegal “detainer” over the phone, Kate Steinle might very well be alive.
