Attorney indicted on felony aggravated assault charge
A local attorney has been indicted on a felony aggravated assault charge concerning an incident involving a woman on March 29.
Daniel Duane Morgan, 40, of 203 E. Fifth Ave., was originally arrested and charged with misdemeanor battery under the Family Violence Act on the day of the incident, but the Floyd County grand jury indicted him on the felony charge Friday.
Morgan is accused of choking the woman by grabbing her neck and squeezing, the indictment stated. Morgan’s attorney, Robert Rutledge, filed a motion in May stating that Morgan was defending his personal property — in this case a small dog — from the woman and should be immune from any further prosecution in this case.
All four Floyd County Superior Court judges have recused themselves from the case and a senior judge, Judge Shepherd L. Howell, has been appointed to preside over the case.
A hearing has been set for the case on June 30 at 9 a.m.
Morgan ran for the office of Floyd County District Attorney in November 2008 and lost to current District Attorney Leigh Patterson. Patterson has also recused herself from the case and it has been assigned to the Paulding County District Attorney’s Office.
