Bond revoked, Gordon BOE member Smith returns to jail

A June drug arrest is ruled to violate Ricky Smith’s bond for August 2016 theft charges.

CALHOUN — Gordon County Superior Court Judge David K. Smith on Thursday revoked the bond of Gordon County Board of Education member Ricky E. Smith, 45, returning him to jail.

According to a motion filed by the District Attorney’s office on Thursday, a new arrest of Smith on June 19 on charges of possession of Schedule IV and Schedule V con- trolled substances violated a bond from Aug. 16, 2016, which was granted on various felony charges Smith faced concerning financial transactio­n card theft, identity fraud, theft by taking, criminal trespass and influencin­g a witness.

Smith was originally arrested on Aug. 15, 2016, after a theft of currency and credit cards was reported from a private residence in the Red Bud community. The theft was reported on Aug. 12, 2016. Smith posted a $20,000 bond on the evening of Aug. 16, 2016, and was released from jail.

According to court documents, sometime between Aug. 5 and Aug. 17, 2016, Smith took the wallet of Linda Joy Poole from a home in the Red Bud community, where he is accused of taking seven credit cards without Poole’s consent with the intent to fraudulent­ly use the cards. The documents also state that Smith “did willfully and fraudulent­ly possess with intent to fraudulent­ly use” a State of Georgia driver’s license and a Social Security card, both belonging to Poole.

Smith was indicted in Gordon County Superior Court in March 2017 on 19 total counts including seven counts of financial transactio­n card theft, nine counts of identity fraud and a count each of theft by taking, criminal trespass and influencin­g a witness.

The newest arrest, according to the Gordon County Sheriff’s Office, happened early June 19, when Smith was booked into the Gordon County Jail after being pulled over for a minor traffic offense. The deputy who pulled Smith over ran a check of his driver’s license, which revealed the license was suspended. The arresting deputy, according to the GCSO, also found a container of what was believed to be Schedule IV and Schedule V prescripti­on drugs in the car. Smith was arrested without incident.

Smith now also faces charges in the June arrest of felony possession of Schedule IV controlled substance, felony possession of Schedule V controlled substance, and misdemeano­r charges of possession of Schedule IV controlled substance, driving while license suspended and obeying traffic control devices.

According to Andrew Garland with the District Attorney’s office, a calendar call on the original charges stemming from the August 2016 arrest is set for Aug. 3 in Gordon County Superior Court. Smith is expected to remain jailed until the next court date.
