Life without parole for man who stalked mistress’s family, killed her husband

CANTON — A man who stalked his mistress’s family while they were on a trip to Georgia and who shot her husband to death in Holly Springs was sentenced to life in prison without parole on Monday afternoon by Cherokee County Superior Court Judge Tony Baker.

Robert Derek Gialenios, 36, of Gainesvill­e, was charged with the Jan. 21, 2017 shooting death of Montana resident Bryan Overseth, who was in Holly Springs with his wife Kerri and children visiting friends and family when he was gunned down outside a relative’s home in the Harmony on the Lakes subdivisio­n. He was convicted on Thursday of malice murder, felony murder, aggravated assault, and possession of a firearm during the commission of a felony.

Prosecutor Zachary Smith described the attack as a cold-blooded ambush in which Gialenios shot Overseth between the eyes as the victim was out walking his dog.

Over the course of the two-week trial the prosecutio­n laid out a scenario in which Gialenios followed the family on their trip to Holly Springs because he was having an affair with Overseth’s wife.

After the slaying, Gialenios attended the burial of Overseth and two days later left a rose, Valentine cards and an invitation for a date to the victim’s wife, Smith said. After that Gialenios was arrested for stalking and later charged with killing Overseth.
