Man accused of pulling rifle on police
Dinner date called cops when Moss wouldn’t return dish
A Royal Oak man faces felony assault and firearm charges after police say he pointed a rifle at a police officer.
James Moss, 34, was arraigned Jan. 1 on the counts.
Police were called to Moss’s house in the 900 block of Mayfield about 9: 30 p.m. Dec. 30 by a woman who had a dinner date with the suspect at his house, police said.
The woman, 28, told police the suspect argued with her and she left.
Police, however, said they had no information on what caused the argument.
“She brought a dish to the house for the dinner,” said Royal Oak police Lt. Albert Carter. “After she left she decided to go back to get her dish back and he wouldn’t give it to her.”
Police said the woman then called police.
“Officers knocked on the door and the suspect had a rifle when he answered the door,” Carter said. “He pointed it at the officer and told him to get off the porch.”
Royal Oak police set up a perimeter in the area, keeping traffic away from the house as they worked to resolve the situation.
The suspect is believed to have been intoxicated at the time, according to Carter.
“We told him to come out with his hands up and he complied,” he said.
Police said they ended up seizing 14 firearms from the suspect’s house, including six handguns, rifles and shotguns.
Moss was jailed on $150,000 cash bond at his New Year’s Day arraignment before Oakland County District Magistrate Courtney Marshall.
He is charged with assault with a dangerous weapon, and possession of a firearm in the commission of a felony.
The assault charge is punishable by up to four years in prison,
and the firearm charge is a two-year felony.
Police said Moss has no prior criminal history.
He is scheduled to appear before Royal Oak 44th District Judge Derek Meinecke for a probable cause conference at 9 a.m. Jan. 11.
