Man, 18, accused of sex with girl, 13

A Santa Fe County magistrate on Wednesday ordered the conditiona­l release from jail of an 18-year-old Santa Fe man who admitted to police he had sex with a 13-year-old girl, according to court records.

State police Officer Joshua Silva wrote in an arrest warrant affidavit that he was searching for the girl Tuesday morning after her mother reported her missing.

Silva said in the statement that he was able to track the girl’s cellphone to the Vista Alegre Apartments in the 1400 block of Zepol Road.

Alonso Guevara Zambrano emerged from one unit, the affidavit says, and eventually told the officer the girl was in the shower.

Zambrano at first denied she was inside, Silva said.

Silva found the girl putting her socks on and brought her to his patrol car, the affidavit says.

Zambrano admitted to having sex with the girl earlier that morning, according to the affidavit. Asked if he knew the girl was only 13, Zambrano “got very surprised and began rubbing his hands through his hair and stated, ‘She’s only 13?’ ”

Zambrano faces one fourthdegr­ee felony charge of criminal sexual penetratio­n of a child between 13 and 16.

Magistrate Donita Sena ordered his release from jail on electronic monitoring. Sena said in her release order that Zambrano has no criminal

history and is not a flight risk.
