Teen charged over shots fired at complex

Santa Fe police filed charges Thursday against a teen accused in a fight last month that resulted in shots fired at the midtown Tuscany at St. Francis apartment complex. The incident disrupted traffic for hours, temporaril­y displaced apartment residents and forced students at two nearby schools to shelter in place.

According to an affidavit for an arrest warrant filed in the Santa Fe County Magistrate Court, Damian Cintron, 18, is charged with aggravated assault with a deadly weapon, contributi­ng to the delinquenc­y of a minor and illegally carrying a handgun before the age of 19.

The arrest warrant says the fight started when a woman threatened to beat up Cintron’s 16-year-old girlfriend, accusing her of stealing some clothing. When the woman approached the teen girl, who was sitting in the front passenger seat of a car driven by Cintron, he started to drive away.

Cintron then pointed a gun at the woman and fired two shots, the woman told police.

Cintron told officers that he had taken the .32-caliber gun from his girlfriend so she wouldn’t shoot the woman. He admitted to pointing the gun at his girlfriend’s attacker, according to the affidavit, but says he never fired it.

The court document says police found the .32-caliber gun and two other firearms in Cintron’s car.

Cintron was charged with aggravated assault and resisting an officer last year, court documents show. Those charges were dismissed without prejudice and could be refiled in state District Court.
