July 23, 1968: A petition asking for an injunction to void action taken at the May 27 Santa Fe school board meeting in which Supt. Calvin C. Capshaw was fired will be filed in Santa Fe District Court within a few days, Santa Fe attorney Joe Lawler told The New Mexican this morning.
The action follows Wednesday’s refusal by the State Board of Education to order an investigation of alleged improper procedures used by the local board in firing Capshaw.
The injunction will be asked, Lawler said, on grounds that the meeting was improperly constituted according to school board procedure and that Capshaw was denied his right to due process during the meeting.
