Two of three arrested teens on house arrest

Teenage girls were passengers in a car with another juvenile who allegedly opened fire; he will remain jailed until trial

The third juvenile involved in the case, 17-year-old Axel Zamarron, who is accused of shooting at a car carrying Martinez and three other young people, will continue to be detained until his trial, District Attorney Marco Serna told The New Mexican.

In total, seven people have been arrested in connection with the Oct. 4 shooting on N.M. 68 near the Ohkay Hotel Casino that killed Martinez, 18, and wounded his three friends.

of 22-year-old Mark Hice. While

traveling northbound on N.M. 68 north of Española, Hice’s armed posse became spooked when a blue Subaru accelerate­d

toward them, police say. Hice, Zamarron and Anton Martinez,

19, are accused of opening fire on the car.

The three young men and Hice’s girlfriend, Brittany Garcia, who police say

was driving one of the group’s two cars, have been indicted on multiple felony counts including first-degree murder.

Another adult riding with the group, 23-year-old Savannah Martinez, was

indicted on charges of conspiracy to commit murder and conspiracy to commit

shooting at or from a motor vehicle.

Katryna Moya, 17, and Alejandra Gonzalez, 16, who police say were riding

in a car with Zamarron at the time of

the shooting, face charges of tampering with evidence, conspiracy to commit aggravated assault with a deadly

weapon and conspiracy to commit tampering with evidence.

Both juvenile girls appeared Wednesday in First Judicial District Judge Mary Marlowe Sommer’s courtroom, where their defense attorneys and prosecutor­s agreed the girls could be released on house arrest, with GPS monitors and a strict warning against possessing any weapons or contacting co-defendants in the case.

Zamarron appeared in front of First Judicial District Judge Jason Lidyard on Wednesday morning for a pretrial detention hearing, Serna said.

In their motion for pretrial detention, prosecutor­s argued Zamarron is too dangerous to be released into the community before the homicide trial.

The motion said Zamarron “geared up,” taking a gun from Hice, and willingly caravaned with the group “knowing that he was expected to shoot someone that evening.”

In an interview after his arrest, the motion said, Zamarron told police he had doubted the blue Subaru he shot at actually was carrying any enemies of Hice. Hice had been looking for a man named Louie, Zamarron said, and “he knew Louie did not drive a Subaru.”

But when Zamarron heard gunshots, the court document said, he opened fire himself, possibly emptying an entire magazine into the car carrying Cameron Martinez and his friends.

“None of the four victims in the Subaru had anything to do with [Zamarron] or the others involved in the shooting,” the motion said. “The blue Subaru was riddled with bullets, and every single one of its occupants were struck with gunfire that night simply for being unlucky.”

Lidyard ruled to keep Zamarron jailed pending his trial, Serna told The New Mexican.
