On May 11, the Santa Fe City Council approved and adopted a revised version of 14-6.2 of the Land Use Developmen­t Code pertaining to short-term rentals. The revisions removed certain limitation­s on these rentals, changed the annual fee structure, and required that all permit holders pay all applicable taxes or face certain penalties.

Prior to these changes, the ordinance only allowed for 350 short term rentals within city limits that were residentia­lly zoned, and limited the number of rentals to 17 per year. The revised ordinance has increased the cap, allowing for a total of 1,000 units, and removed the limitation on the number or rentals per year. However, the limitation on only one arrival per week was unchanged.

Other changes include that permits will not be issued to units that directly adjoin each other unless in a condo, townhome, or apartment community. Prior to the changes in the ordinance, owners of properties in commercial districts did not need to apply for a permit and under the new ordinance applicatio­ns must be completed and a permit must be issued.

These changes allow for the city to more effectivel­y manage short-term rentals. Before, it was nearly impossible for enforcemen­t officers to determine if properties being advertised online were in violation primarily due to the fact that properties in commercial districts did not have permit numbers associated with the advertisin­g. The city can now focus efforts toward enforcing the items that matter most to the neighborho­ods and our community as a whole and not get bogged down in the minutiae of, “Is the rental legal or not?”

If you are concerned that a short-term rental in your neighborho­od will affect your quality of life, don’t be! Familiariz­e yourself with the process and report violations when they arise. Should there be continued issues with trash, parking, or noise, the rental can be shut down but that will only happen if you report the violations. Additional­ly there is an owner, operator, or property manager available 24/7 to respond to such complaints.
