Fitchburg man in court for disturbing the peace charges

-

After being cited twice in less than two hours for disturbing the peace in November and domestic assault and threat to commit a crime and then a third time on Christmas day, a city man appeared in court to answer for the third charge, according to police and court documents.

Police said that at 11:35 p.m. Nov. 9, officers were called to the residence of Jonathan Feliciano, 28, of 205 Highland Ave., for a third time that day on a report of loud music, and after explaining to Feliciano about the noise, cited him for disturbing the peace, police said.

Less that two hours later, officers were called back to Feliciano’s residence, this time on a report of a loud disturbance that was getting complaints by the neighbors that included yelling from inside the apartment, police said.

When the officers arrived, they heard yelling and when they knocked on the door of the residence, they were met by Feliciano’s wife, who told them Jonathan Feliciano was intoxicated and causing a disturbance by yelling, police said.

The officers attempted to speak to Jonathan

Feliciano about the disturbance but he continued yelling and shouting profanities at his wife, police said. For a moment, he calmed down, but then spit in his wife’s face and was promptly placed under arrest for domestic assault and battery and disturbing the peace, police said.

When speaking to Feliciano’s wife after his arrest, she told the officers that after every time they had visited the residence during the two days, as soon as they left, he would be an “(profanity) and turn the music back up.

Feliciano, who pleaded not guilty, was arraigned on Nov. 10 on the three charges and released on personal recognizance, according to court documents.

And then on Christmas Day, officers were again called to the Feliciano residence on a report of loud music by a neighbor who had reported the loud music twice the day before and three times on Dec. 25, police said.

The final call from the neighbor was for Feliciano yelling at him and threatening to shoot and kill him, police said.

For this incident, Feliciano was charged with disturbing the peace, again, and threat to commit a crime, police said.

He was arraigned on the two charges on Dec. 28 and ordered to stay away from and have no contact with the victim, according to court documents. He was released after his final arrest after posting a $200 cash bail, according to court documents.

Feliciano will return to court on Jan. 14 for a hearing on all the pending charges.

Feliciano’s wife told officers that after every time they had visited, as soon as they left, he would be an ‘(profanity) and turn the music back up.’
