Police: Stamford man charged with sexually assaulting girl, fathering child

STAMFORD — A city man was held in lieu of a $250,000 court appearance bond this week following a nine-month investigat­ion that led to his arrest on charges of sexually assaulting a 14-year-old Stamford girl.

The girl, according to an arrest affidavit, gave birth to a child following the assault.

Victor Garcia, 41, was charged with first-degree sexual assault, seconddegr­ee sexual assault and two counts of illegal sexual contact with a victim under 16. After setting bond at his arraignmen­t this week,

Judge Gary White transferre­d the case to the courthouse’s Part A docket where the most serious cases in the judicial district are adjudicate­d.

Garcia pleaded not guilty to the charges.

His public defender, Howard Ehring declined comment on the case.

According to his six-page arrest warrant, on March 3, a woman showed up at Stamford police headquarte­rs with her daughter after taking the girl to Stamford Hospital because she had a stomach ache and was vomiting. At the hospital, the woman discovered that her daughter was pregnant, the affidavit said.

The girl told police investigat­ors that Garcia, a Guatemalan citizen, had assaulted her twice.

A few days later at a multidisci­plinary interview that included police plus Department of Children and Families and Child Guidance Center of Southern Connecticu­t personnel, the girl described incidents when Garcia allegedly assaulted her, according to the affidavit.

Police then found Garcia and with his permission took a sample of his DNA, according to the affidavit. But Garcia would not talk to investigat­ors about their investigat­ion involving the girl, the affidavit said.

In late September the girl gave birth to a baby boy, and a little over a week later the girl, her mother and the baby went to police headquarte­rs where a DNA sample was taken from the boy, according to the affidavit. On Oct. 28, police received confirmati­on from the state Forensic Science Laboratory that based on the DNA analysis Garcia was a “parental contributo­r,” the arrest affidavit said.

Garcia is scheduled to return to court Jan. 3, 2021.
