Police: Stamford man charged with sexually assaulting girl, fathering child
STAMFORD — A city man was held in lieu of a $250,000 court appearance bond this week following a nine-month investigation that led to his arrest on charges of sexually assaulting a 14-year-old Stamford girl.
The girl, according to an arrest affidavit, gave birth to a child following the assault.
Victor Garcia, 41, was charged with first-degree sexual assault, seconddegree sexual assault and two counts of illegal sexual contact with a victim under 16. After setting bond at his arraignment this week,
Judge Gary White transferred the case to the courthouse’s Part A docket where the most serious cases in the judicial district are adjudicated.
Garcia pleaded not guilty to the charges.
His public defender, Howard Ehring declined comment on the case.
According to his six-page arrest warrant, on March 3, a woman showed up at Stamford police headquarters with her daughter after taking the girl to Stamford Hospital because she had a stomach ache and was vomiting. At the hospital, the woman discovered that her daughter was pregnant, the affidavit said.
The girl told police investigators that Garcia, a Guatemalan citizen, had assaulted her twice.
A few days later at a multidisciplinary interview that included police plus Department of Children and Families and Child Guidance Center of Southern Connecticut personnel, the girl described incidents when Garcia allegedly assaulted her, according to the affidavit.
Police then found Garcia and with his permission took a sample of his DNA, according to the affidavit. But Garcia would not talk to investigators about their investigation involving the girl, the affidavit said.
In late September the girl gave birth to a baby boy, and a little over a week later the girl, her mother and the baby went to police headquarters where a DNA sample was taken from the boy, according to the affidavit. On Oct. 28, police received confirmation from the state Forensic Science Laboratory that based on the DNA analysis Garcia was a “parental contributor,” the arrest affidavit said.
Garcia is scheduled to return to court Jan. 3, 2021.
